Law nº 12/23, of 27 December [2023], which approved the General Labour Law, was recently published, revoking the former Law nº 7/15 of 15 June [2015]. Among the changes introduced, we highlight the following:
- fixed-term employment contracts are only allowed in very exceptional situations provided for and typified by law, thus the employment contract for an indefinite period has become the norm.
- new disciplinary measures were introduced, namely (i) temporary category demotion, and (ii) suspension from work without pay.
- elimination of the categorization of companies as micro, medium, small, and large companies for the purposes of calculating compensation and severance packages.
- flexible working hours were introduced for employees with family obligations.
- Complementary maternity leave was introduced (granted for a period of four weeks and non-remunerated).
- paternity leave was introduced (granted for seven business days, consecutive or interpolated, non-remunerated).
- a new chapter on personality rights was also introduced.
This law will come into force 90 days after the date of its publication.
